WAHM Hosting Terms of Service Agreement

By signing up for our service, you agree to all of the following terms and conditions. These terms may be changed at any time and you agree to be bound by any modified terms. You must be 18 years of age or older to use our services and by signing up with us, you agree to these terms as well as our disclaimer even if you do not read them in full.

Note: WAHM Hosting is a subsidiary of WAHM Productions. The two names are and should be treated as interchangeable for the purposes of this agreement.

Account Setup

Your account will be setup either directly after payment is made or once we determine that the order is legitimate. It is your responsibility to provide us with an email address that is current and to keep that information up to date with us. You may not sign up with an email address @ the domain you are signing up with since we will not be able to reach you during the setup process. We will cancel your service if we find anyone with false contact information.

Privacy

Your information is confidential. We do not release this information to third parties unless you have committed a criminal act, we have received a court order, or you have violated our Terms of Service. We do not spam or sell your information to anyone. We do reserve the right to send you emails relating to our service, but none of these emails contain advertisements.

Content

You are responsible for the content on your web site. We provide a service in which we offer to install a script on your web site upon registration. All scripts are third-party scripts. It is not our responsibility to maintain the script or your web site. Enough information is provided about each script we recommend to lead you in the direction of further help. We provide these scripts as a tool to help you get started with your web site. This is strictly a courtesy installation. If you need us to do further work on your web site, there will be fees involved. We will not work on ANY client's web site for free. The only exceptions to this are issues pertaining to the hosting itself. You may contact us about prices pertaining to our web site services if you need help setting up or maintaining your web site.

All services provided by WAHM Hosting may only be used for lawful purposes. The laws of the State of Florida, the State of Texas, and the United States of America apply. You agree to indemnify and hold harmless WAHM Hosting from any claims resulting from the use of our services. We do not allow the following: no adult material, no illegal sites (such as warez sites), no abuse of server resources, no exploiting of server software, no hosting of illegal files (such as copyrighted music), no mass-mailing/spamming, no unsolicited commercial advertisements through discussion groups, mailing lists, and the like. Basically, keep it family friendly.

We reserve the right to review and remove any material that, in our judgment, is obscene, threatening, or otherwise prohibited by us. We reserve the right to refuse service to anyone. We reserve the right to terminate or suspend accounts in violation of our terms at any time without notice. If we contact you about the material on your web site, you will have 48 hours in which to respond before we take action. Violations will be reported to the appropriate law enforcement agency.

Licensed Scripts

Several of the scripts we offer through our hosting are licensed to us through third-parties. Each script is different in how the licenses work.

We are authorized to resell certain licenses. To purchase or lease a script license, visit this page: https://wahmhosting.com/clients/cart.php?gid=10.  Please note that although we are able to resell and install these third-party scripts, we are not required to provide support for them. While we do try to help where and when we can, we do suggest going directly to the script creators for support.

Online Store Cart is licensed to us for use on our servers. The server based license we were given is available for use to all of our hosting customers. If you wish to move your website to another host, you will have to purchase a separate license for the script.

JROX & Ventrino scripts are licensed to us as well, and may be purchased through us directly for a discounted rate.

Online Store Cart

One of the scripts we offer is now referred to as Online Store Cart. Again, we provide this script as a simple courtesy. If you chose to use this script, you agree that you will keep the small credit line at the bottom that states that the web site is powered by WAHM Hosting. If you need to change this credit line to better fit your template, you may do so, but only if you add it back in on every page of your web site (preferably at the bottom of your template). Removing this credit is a violation of the terms of the cart. If you wish to remove the credit line, there will be an additional monthly fee to do so. Contact us for details.

Backups/Data Loss

WAHM Hosting is not responsible for loss of data. We provide daily as well as weekly backups on our servers. However, we will not be held accountable for lost or corrupted data on any account with us. We strongly recommend you keep backups of your web site. If you need us to restore a full or partial backup for you, there will be fees involved.

Uptime

WAHM Hosting guarantees 99.9% uptime. If there is any downtime beyond what we guarantee, a partial refund may be granted. The refund request must be made within 5 business days of the event and we must be able to determine on our end that it was server related and not due to an error on your account. Rarely, we will need to perform maintenance on our servers. This may effect speed and/or uptime. In the event that we are performing maintenance, our customers will generally be contacted in advance.

Domains

All domain registrations, transfers, and renewals are processed through our domain registrar. You agree not to hold WAHM Hosting responsible for any domain dispute. Upon registration, you are responsible for the correct spelling of your domain name. We will not refund any money for domains. You are responsible for renewing your domain before the expiration date. Failure to renew on time will result in retrieval fees.

Resellers

Resellers are responsible for supporting their own clients. We will direct all emails from reseller's clients to the reseller. In the event that a reseller needs additional help, there will be additional fees incurred for use of our support. The only exception to this is if there are issues relating to the hosting itself. Resellers will be contacted in the event that any of their customers violates our terms. We reserve the right to suspend/terminate web sites violating our terms before contacting our resellers. Resellers are also responsible for the content on their own web sites Resellers may not copy any of the information found on WAHM Hosting without written consent. Resellers must also abide by all other terms in this agreement.

Individuals may not resell hosting through WAHM Hosting unless they have a reseller account. You may not sign up individuals for our hosting under the pretense that you are a part of our staff. You may represent yourself as an affiliate as described below.

Affiliates

Affiliates may not act on behalf of WAHM Hosting. Affiliates are paid a percentage fees paid to WAHM Hosting by their referrals. Affiliates may request payment in the form of credits at WAHM Hosting to be used for hosting or other services provided by us. Affiliates may also request payment through PayPal. Payments must be requested through your account. There is a 31 day waiting period on all referral fees to ensure that the referred member does not request a refund.

Spam Policy

You may not send spam through our service. All recipients must opt in to any mailing list. We also ask that you limit your mailings to under 500 emails per hour. Any account found to be in violation of this policy will be fined, suspended, or terminated at our digression.

Billing and Payment

WAHM Hosting accepts Visa, Master card, and PayPal. A note about PayPal: PayPal payments will not be refunded! By creating a PayPal subscription, you are telling PayPal to send us a certain amount of money each term. This will continue until you tell them to stop or your payment details on file with them change. Again, PayPal subscriptions will continue until YOU stop them! If you accidentally setup two or more PayPal subscriptions, it is your responsibility! Duplicated PayPal payments will not be refunded. Instead, a credit will be applied to your account at WAHM Hosting. In the event that we apply a credit to your account for any reason, note that promotions, specials, etc apply the discount to the end of your term. If you close your account with us, those credits will be lost. Just to clarify once more, PayPal subscriptions are your responsibility! This may seem harsh, but PayPal has been known to disable accounts that have a high level of refunds and we must do what we can to ensure the safety of our PayPal account. If we jeopardize our standing with PayPal, we will no longer be able to use them as a payment processor.

Credit Cards will be billed each term. Credit card billing will stop after you have made your request to cancel your account. It is your responsibility to keep your credit card information up to date if you are paying by credit card. Any invoices created will automatically charge your credit card. Keep this in mind when asking us to invoice you for work. Also note that credit card payments will show up on your bill as from WAHM Productions. If you file a charge back with your credit card company, we will charge you the full charge back fee that we incur.

Late fees will be added to invoices after a predetermined amount of time has passed without payment. If the invoice is still not paid, the service will be suspended until payment is made. Note that invoices will continue to be created during this time. It is your responsibility to pay on time each month. We recommend keeping a credit card on file with us so that this does not happen. Failure to pay will result in termination. There will be no exceptions!

Cancellation / Refunds

All accounts are set up on a pre-pay basis. All pricing is guaranteed for the term of pre-payment. We reserve the right to change prices at any time.  The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies WAHM Hosting for a request for termination of services.

WAHM Hosting does not require contracts for shared hosting. This means that you may cancel your service at any time.  There will be no refunds given.  There are no refunds for any hosting fees, setup fees, license fees, additional purchases, or the like.

Resellers who sign up with our All-Inclusive plan agree to a twelve (12) month contract when agreeing to these terms. The contract is mandatory due to the licenses purchased buy us for use of the reseller. Canceling before the end of the contract will result in a fee of $59.99 per month left on the account. Agreeing to these terms means that you agree to the contract. All-Inclusive Resellers may choose to avoid this contract by paying an initial setup fee of $500 for the account.

Indemnification

You agree to indemnify, defend and hold harmless WAHM Hosting, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this agreement (including negligent or wrongful conduct) by you or any other person accessing the service. We will not tolerate rude or threatening emails. We will also not tolerate any form of slander of our web site, our services, or our support staff. Violation of this can result in termination and possible legal action.
